Step 1: Make Sure You Meet the Requirements to Become a Surrogate in New York

To be a surrogate in New York, you should:

  • Be between 21 and 43 years old
  • Have a body mass index (BMI) between 18 and 32
  • Have a history of full-term, uncomplicated pregnancies
  • Have had no more than 5 deliveries or 3 c-sections
  • Be a U.S. citizen or legal permanent resident living in New York
  • Not smoke or vape or have a history of drug or alcohol abuse
  • Not be treated for or on medication for serious depression or anxiety or another psychological disorder
  • Be financially stable and not receiving government cash assistance

A Guide to Surrogacy Laws in New York

New York’s surrogacy law – the Child Parent Security Act (or CPSA) – makes compensated gestational surrogacy legal in New York.  New York’s law for surrogacy established a few unique things that are important to know:

  • New York surrogates looking for the support of a surrogacy agency must work with a licensed agency (or “matching program”).  The licensing progress – the first of its kind in the nation – is meant to ensure that the agency is conducting its program ethically and using best practices. Brownstone has license number GS221023.
  • Agencies licensed by New York state cannot have conflicts of interest – meaning that there is no financial relationship between Brownstone and any fertility clinic or lawyer or other third party that is part of your surrogacy journey.
  • Every surrogacy journey is supported by an independent and insured escrow agent, ensuring the financial aspects will be handled professionally.
  • Every New York surrogate is supported by the Surrogate’s Bill of Rights, which includes protections like robust life insurance coverage, mental health support, postpartum health coverage, and the right to make one’s own health and welfare decisions.
  • Fertility clinics working with surrogates also need to be registered with New York State.

The New York Family Court Act allows for pre-birth orders for intended parents regardless of whether they are married or unmarried, heterosexual or same-sex, using an egg or sperm donor or not.  This means that the intended parents’ names go on the birth certificate!  New York law is really great for compensated gestational surrogacy.
