Step 1: Make Sure You Meet the Requirements to Become a Surrogate in Illinois

To be a surrogate in Illinois, you should:

  • Be between 21 and 42 years old
  • Have a body mass index (BMI) between 18 and 32
  • Have a history of full-term, uncomplicated pregnancies
  • Have had no more than 5 deliveries or 3 c-sections
  • Be a U.S. citizen or legal permanent resident living in Illinois
  • Not smoke or vape or have a history of drug or alcohol abuse
  • Not be treated for or on medication for serious depression or anxiety or another psychological disorder
  • Be financially stable and not receiving government cash assistance

A Guide to Surrogacy Laws in Illinois

The Illinois surrogacy law makes gestational surrogacy legal in Illinois. Illinois law for surrogacy establishes a few unique things that are important to know:

  • Illinois has an administrative parentage process that is one of the easiest in the country.
  • For a surrogacy arrangement to be enforceable under law, at least one intended parent must be the biological parent of the child (although there is an alternative path to parentage available to non-genetic parents).
  • Surrogates must be at least 21 years old, undergo medical and mental health evaluations, have already given birth to at least one child, and have a health insurance policy that covers major medical treatments and hospitalization.
  • Intended parents and the surrogate must have separate attorneys.
  • Attorneys confirm the parental rights of the intended parents through an administrative process with the Illinois Department of Public Health in coordination with the delivery hospital. Then Illinois Vital Records will issue a birth certificate with the intended parents’ information upon birth.
  • However, should intended parents want or need a court order, attorneys can also pursue a process through the courts.

The total estimated cost of a surrogacy journey in Illinois is around $175,000 though it can fluctuate.
